In-Canada PR Applications Guide

What it is

Pathways for people already living in Canada who don’t fit standard economic or family classes: applications on humanitarian and compassionate (H&C) grounds — an exceptional, discretionary measure — and PR for protected persons (granted refugee protection). In-Canada spousal sponsorship and Canadian Experience Class are covered in their own guides.

Who is eligible

H&C: exceptional cases only — not an alternative to a class you qualify for; officers weigh establishment in Canada, family ties, children’s best interests, and hardship if refused. Cannot apply with a pending refugee claim (must withdraw before the IRB hearing) or within 12 months of a negative refugee decision (one-year bar), with narrow exceptions. Risk factors like persecution go through the refugee process, not H&C.

Protected persons: Convention refugees or persons in need of protection may apply for PR for themselves and eligible family members.

The process

  1. Confirm no standard class fits (H&C is last-resort).
  2. Identify exemptions requested; gather evidence per factor.
  3. Complete forms (IMM 0008, IMM 5283, IMM 5669 Schedule A, family forms).
  4. Write a detailed submission letter tying claims to evidence.
  5. Pay fees; submit.
  6. Respond to IRCC requests within deadlines.
  7. Written decision (Stage 1 approval-in-principle, then admissibility checks).

Document checklist

Identity/travel documents; establishment proof (employment, tax, leases, bills); family ties and children’s best-interests evidence; school/medical records; country-condition evidence; support letters; medical/psychological reports; police certificates and medicals when requested; fee receipts.

Important warnings

  • H&C decisions are highly discretionary with very long processing times.
  • Since July 2026, officers cannot use H&C to exempt requirements set out in temporary public policies.
  • Withdrawing a refugee claim for H&C has permanent consequences — get advice first.
